Pendens Labs

A privacy claim arrives as a letter. What is it worth?

Pendens Labs is building claim-level analytics for website-tracking and wiretap claims, for the cyber insurers, brokers and claims teams that have to price and resolve them.

Exposure is visible. Outcomes are not.

Scanners can show which trackers a website runs. They can't say what happens when a demand letter cites them: whether the theory survives a motion to dismiss in that court, how the plaintiff's firm usually resolves, or what the claim costs to close.

Many of these claims resolve before suit, so the outcomes that matter often never reach a public docket. That gap is what we're working on.

What we're building

An assessment for each new claim, built from court records and, with partners' permission, their claims outcomes:

  1. The theories, checked against the court. How claims under CIPA, the federal Wiretap Act, VPPA and related statutes have fared on motions in the relevant court.
  2. The plaintiff's firm, by its record. How often its letters become lawsuits, and how its claims typically resolve.
  3. A range, with its sources. Settlement and defense-cost ranges, with the cases behind every number and the sample size shown.
  4. A flag when the law moves. Statutes and appellate rulings change what claims are worth. California’s SB 690, for example, ends private pen-register suits over website tracking on January 1, 2027.

We're in the research phase and looking for a small number of cyber claims and underwriting teams to work with. If you handle privacy claims at a carrier, MGA or broker, we'd like to hear how you triage and reserve them today.
